REQUEST TO AMEND REGISTRATION AND STATEMENT UNDER 37 C.F.R. § 2.52(a) Pursuant to Rule 2.173, Registrant, White Systems, Inc., hereby applies to amend the referenced Registration. The mark has been immaterially amended in the following inconsequential way: the lettering has been revised from two words, POWER COLUMN, to one word POWERCOLUMN. An amendment of a registered mark is acceptable if the modified mark contains the essence of the original mark and creates essentially the same impression as the original mark. In re Uma v. Data Systems Inc., 40 USPQ2d 1539 (Comm’r Pats. 1996). As noted in TMEP 1609.02(a), variations in lettering style and other elements of form do not materially alter a word mark. Therefore, the change from two words to one word is an acceptable amendment. Registrant’s revised mark creates essentially the same impression and contains the essence of the original mark. The amendment merely seeks to conform the registration to Registrant's current and updated use. Furthermore, re-publication of the mark would not be required given the insignificant and minor revisions to the mark. In light of the foregoing, Registrant requests approval of this amendment. Additionally, Registrant submits herewith a statement as required by 37 C.F.R. § 2.52(a). The required statement is as follows: The mark is presented in standard characters, without claim to any particular font, style, size, or color. The undersigned being warned that willful false statements and the like so made are punishable by fine or imprisonment, or both, under 18 U.S.C. 1001, and that such willful false statements and the like may jeopardize the validity of this document, declares she is properly authorized to execute this document on behalf of the owner, and all statements made of his/her own knowledge are true and that all statements made on information and belief are believed to be true. |
