Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 1642768 ASTROS :

FORM INFORMATION

This is with respect to the Combined Section 8 Affidavit & Section 9 Renewal Application filed in support of Reg. No. 1,642,768 on April 30, 2011.  A Post Registration Office Action was issued on May 23, 2011, in connection with the Section 8 Affidavit portion of the foregoing submission (hereinafter, the "Section 8 Affidavit Office Action").  The Post Registration Trademark Specialist issued the Section 8 Affidavit Office Action because the party who filed the Combined Section 8 Affidavit & Section 9 Renewal Application, Houston McLane Company, LLC, a Texas limited liablity company, differed from the owner of record of Reg. No. 1,642,768, Houston McLane Company, Inc., a Texas corporation.  However, Houston McLane Company, Inc., a Texas corporation, was converted to Houston McLane Company, LLC, a Texas limited liability company, effective July 28, 2009 (hereinafter, the "Conversion").  The Conversion has now been recorded against Reg. No. 1,642,768 (and others) in the U.S. Trademark Office Assignment Branch, effective July 15, 2011, at Reel/Frame 4584/0271.  A copy of the Notice of Recordation is attached hereto.  Since the foregoing recordal resolves the only issue in the Section 8 Affidavit Office Action, it is respectfully requested that the Combined Section 8 Affidavit & Section 9 Renewal Application now be accepted.   It is noted that the Post Registration Trademark Specialist herein also issued an Office Action regarding the Section 7 Amendment filed in support of Reg. No. 1,642,768.  A response to the Section 7 Amendment Office Action issued by the Trademark Specialist is being filed simultaneously with the response to the Section 8 Affidavit Office Action.

It is further respectfully requested that the processing of each of the Combined Section 8 Affidavit & Section 9 Renewal Application and Section 7 Amendment take place as soon as possible in light of the JULY 30, 2011, FINAL DEADLINE for renewal of the recordal Reg. No. 1,642,768.
