Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 1604952 VECTRA :

FORM INFORMATION

Responsive to the Official Action dated April 24, 2010, Registrant notes that the electronic database of the USPTO apparently did not have the 2001 assignment from Vectra Banking Corporation to Zions Bancorporation which was recorded on September 13, 2001 on Reel/Frame 2371/0311 properly entered into the USPTO renewal/use system so that the renewal/use electronic form displayed old data and still does. Applicant relied on and filed this form electronically and received the official action to which it is responding.  

 

Registrant has noted this previously to Harold D Lee, Trademark Specialist, Post Registration Division by phone call and emails from Registrant’s counsel’s Legal Assistant.  There has been no response to date.

 

In order to comply with the Official Action, Applicant is filing a new Affidavit under Section 8 which is attached hereto. 

 

Clarification and reconsideration of this situation is requested as is the entering of the still timely re-submitted Section 8 Affidavit and specimen of use.   Authorization to take the filing fee check from Counsel’s deposit account has been authorized.
