RESPONSE TYPE Response to Office Action for Combined Declaration of Use and/or Excusable Nonuse/Application for Renewal under Sections 8 & 9.

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

Ownership Inquiry: In response to the Office Action of December 27, 2022, Registrant, Technogym S.P.A. confirms it is a Joint Stock Company. This is verified in the merger (Reel/Frame: 7805/805) and change of name (Reel/Frame: 7806/0001) documents submitted with the Assignment Branch. The recordation of these documents confirms the chain of title. The entry of Corporation in the Declaration of Use and Renewal filing was an inadvertent clerical error and should be corrected to reflect Joint Stock Company. Registrant respectfully requests that the Trademark Office correct the Registrant's entity information to reflect TECHNOGYM S.P.A. as a Joint Stock Company organized in Italy.
