The Section 8 Affidavit, received in the Office on 11/01/06, was submitted too early. 15 U.S.C. §1058(b); 37 C.F.R. §2.160. The Section 8 Affidavit documentation will remain in the record; i.e., the Section 8 Affidavit will not be returned to you and will not be processed or reviewed. TMEP §1604.04(a).
FEES: Unless you request a refund of any fee(s) submitted, the fee(s) will be applied toward a newly executed Section 8 Affidavit, when the Office receives it. The filing fee for a Section 8 Affidavit is $100 per class of goods and/or services. If the Section 8 Affidavit is filed during the grace period, you must include the additional grace period fee of $100 per class (i.e., if you submit your Section 8 Affidavit during the grace period, you must submit a total of $200 per class). 37 C.F.R. §2.6.
