Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 781426 SKYLAND :

FORM INFORMATION

Registrant has received and reviewed the Post Registration Office Action, mailed December 30, 2014, and responds as follows:      

DISCUSSION

The Examiner has rejected the Sections 8 & 9 Combined Affidavit, submitted on November 24, 2014 indicating that there is a break in the chain of title.  Registrant submits that there is no break chain in title, but instead a rogue merger was recorded against the current registration in error.  Specifically, the merger of Champion International Corporation into International Paper Company recorded on September 3, 2002 at Reel 2577, Frame 0513 was executed on December 31, 2000 which occurred after the Assignment of the Entire Interest of the current registration from Champion International Corporation to Blue Ridge Paper Products, Inc. was executed on April 13, 2000.

Based on the execution dates of the Assignment and the completion date of the Merger, the ownership of the mark SKYLAND had already been transferred prior the Merger.  Thus, Champion International Corporation had no remaining rights in the mark to transfer to International Paper Company

CONCLUSION

The foregoing response complies with the requirements of the Post Registration Office Action.  Registrant believes its registration is now in proper form and requests passage of the Section 8 & 9 Combined Affidavit.  Please feel free to contact the undersigned. if any questions remain which may be resolved by phone .
