The Combined Section 8 Affidavit & Section 9 Renewal Application submitted on May 1, 2006, cannot be accepted for the reasons set forth below.
You must submit a newly executed Combined Section 8 Affidavit & Section 9 Renewal Application on or between May 10, 2006 and May 10, 2007, or during the grace period that ends on November 7, 2007. The Combined Section 8 Affidavit & Section 9 Renewal Application, received in the Office on May 1, 2006, was submitted too early. The Combined Section 8 Affidavit & Section 9 Renewal Application must be filed within one year before the registration expiration date, (or the date of publication under 15 U.S.C. §1062(c)), or during the ensuing grace period. 15 U.S.C. §§1058(b) and 1059(a); 37 C.F.R. §§2.160 and 2.182; TMEP §§1604.04(a) and 1606.03.
The Combined Section 8 Affidavit & Section 9 Renewal Application documentation will remain in the record; i.e., the Combined Section 8 Affidavit & Section 9 Renewal Application will not be returned to you and will not be processed or reviewed.
FEES: Unless you request a refund of any fee(s) submitted, the fee(s) will be applied toward a newly executed Combined Section 8 Affidavit & Section 9 Renewal Application, when the Office receives it. The filing fee for a Combined Section 8 Affidavit & Section 9 Renewal Application is $500 per class of goods and/or services. If the Combined Section 8 Affidavit & Section 9 Renewal Application is filed during the grace period, you must include the additional grace period fee of $200 per class (i.e., if you submit your Combined Section 8 Affidavit & Section 9 Renewal Application during the grace period, you must submit a total of $600 per class). 37 C.F.R. §2.6; TMEP §§1604.06(a) and (b) and 1606.05(a) and (b).
