SEARCH RESULTS
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
However, applicant must address the following issues.
“Workbench,” as it relates to software, is “used the metaphor of a workbench for exposing file management and application launching functionality, like in the AmigaOS workbench, or for designing processes connecting data sources to operations and models.” See attached evidence from en.wikipedia.org. The attached evidence from www.genomics.agilent.com, www.ibm.com, and www.st.com shows that “workbench” is commonly used to identify a type of software. Thus, the wording “workbench” merely describes a feature of applicant’s goods.
